Dear Customer,
below we provide you with the information regarding the processing of your personal data that will be carried out by WeLive – JONNY-ES COSTRUZIONI S.R.L. based in C.so Roma, 32 in Carpi (MO) – 41012, C.F. and VAT number 02964840363 (hereinafter referred to as “Company”), about the hotel services it offers (hereinafter referred to as the “Hotel Services”).

A. Data controllers
The Data Controller of the personal data communicated by you at the hotel and during your stay at the same is the Company JONNY-ES COSTRUZIONI S.R.L. whose treatment is governed by this information;

B. Categories of personal data
The personal data that the Company collects are: name, surname, residence/domicile, copy of identity document, e-mail, tax code and/or VAT number, type of room, any third parties with whom the stay will be shared (in hereinafter the “Data”). The processing of the aforementioned data by the Company may also concern – with your express consent – data relating to your health (e.g. physical handicap, for which a particular type of room is requested during the booking process). In these cases, we guarantee that the processing will be limited to the data and operations essential to fulfill the obligations, including pre-contractual ones, relating to the provision of Hotel Services, within the limits of the performances and services requested by you during the booking or during the course of the stay at our hotel.

C. Purpose and legal basis of the processing
The Data is processed for the correct fulfillment of contractual and/or legal obligations in order to execute the Hotel Services. Furthermore, your data are processed to fulfill the obligation outlined in the “Consolidated Law on Public Security Laws” (Article 109 RD 18.6.1931 n. 773) which requires the personal information of the residents to be communicated to the Police Headquarters, for public security purposes, according to the procedures established by the Ministry of the Interior. The data acquired for this purpose will not be stored at the accommodation facility unless the sponsor provides specific authorization. The provision of data for the purposes outlined above is necessary (i) for the provision of Hotel Services and (ii) to fulfill for public safety purposes. In this regard, there is an obligation to provide such data for the achievement of the aforementioned purpose; their failure, partial or incorrect provision could result in the impossibility of providing the Hotel Services requested by you and therefore the impossibility of hosting you at our accommodation facility.

a) Registration procedures: in case of subsequent stays at our facility, upon obtaining your consent which can be revoked at any time, your data will be kept for a maximum period of two years and will be used when you are our guest again for the purposes referred to in the previous points;

b) Video surveillance: for the purpose of protecting people, property, and corporate assets through a video surveillance system with audio and video recording of some common areas of the structure identified by the presence of specific signs. The treatment falls within the purposes of legitimate interest to protect people and property concerning acts of vandalism, theft, robbery, aggression, damage, and protection of corporate assets art 6 paragraph 1 letter F EU Reg. 679/2016. The recorded images are deleted after 24 hours, except holidays or other cases of closure of the business and in any case no later than 7 days as required by law. They are not communicated to third parties except in the case in which it is necessary to adhere to a specific investigative request of the judicial authority or judicial police and/or for investigations following events against people and/or assets, etc.

c) Direct Marketing and Communications: subject to your express consent, the data collected (e-mail address) will be used in order to send information and/or commercial communications/newsletters regarding the hotel where you have decided to stay. The granting of this consent on your part is optional and does not preclude the activities and hotel services requested. You can cancel your subscription to the service at any time by following the procedure indicated in each communication received or by sending a specific communication to the company, at the addresses indicated in section H. (Contact details)

D. Processing methods
The processing of personal data will take place through paper, computer, or telematic tools and with measures of security adequate to guarantee the security and confidentiality of your personal data. The data will be processed by personnel and collaborators of the Company and/or by external subjects duly contractually designated as managers in charge of processing.

E. Processing methods
The Data will also be accessible – for the same purposes for which the collection is intended – to data processors belonging to the following categories:

  • subjects that provide services for the management of the IT system and telecommunications networks of the Company or suppliers of the Wi.fi service for internet connection;
  • consultants of the Company or other subjects who provide services related to the Hotel Service including digital platforms for managing reservations and customer and supplier databases;
  • subjects who take care of the administration and tax and commercial consultancy in the name and on behalf of the Company, tax, IT, and legal consultants specifically contracted as external data processors.

The data may also be communicated to public safety agencies and other public and private entities for the fulfillment of legal obligations, including those of a fiscal, administrative, financial and similar nature. The Data will in no case be disclosed.

F. Transfer of personal data
The data are not subject to transfer outside the EU. Transfers outside the EU, should they occur, are guaranteed through the application of the specifications provided for in Articles 44-45-46-47 EU Reg. 679/2016.

G. Retention period
The Data collected and processed by the Data Controller to execute the Hotel Services may be kept for the limitation period provided for by the applicable regulations, including fiscal ones.
As regards the processing of data for direct marketing purposes, as described in the previous section C., the data are processed for no more than 24 months from their collection and in any case until a request for your cancellation from the service.

You will be able to:

(I) obtain confirmation of the existence or not of personal data concerning you;
(II) know the purposes of the processing and the methods, the recipients of such data, the retention period;
(III) obtain the rectification or cancellation, and where applicable, the limitation of the processing;
(IV) oppose the processing;
(V) where applicable, receive in a structured format, commonly used and readable by an automatic device, the personal data concerning you provided to the Company and transmit such data to another data controller without hindrance by the Company;
(VI) In the cases provided for in Articles from 15 to 22 of the Regulation referring to personal data concerning deceased persons the rights can be exercised by those who have an interest of their own or act to protect the interested party, as their agent, or for family reasons worthy of protection.
